Well, it is a stretch, but the Sword was not in the tomb, but rather it was visible. Orcrist was placed upon Thorin's tomb alongside the Arkenstone, and it is said that the Lonely Mountain could never be taken by surprise thereafter, as the blade "gleamed ever in the dark if foes approached"
though not physically in the tomb with him it was laid to rest with him.
I guess I could have just said "yeah, you got it"
